These Terms and Conditions define the conditions of use of Indie Campers Central Services Unipessoal Lda.'s Platform website (therefore the “Platform”) and the relationships established between the Platform and its Users.
The use or participation in the service of the Platform is exercised, without exception, on the condition that the Users adhere to these Terms and Conditions.
The Platform Terms and Conditions are applicable to all users of the Platform services.
2. Third Party Translation Software
The Platform has the possibility, for users convenience, to use a translation software powered by third party providers. Reasonable efforts have been made to provide an accurate translation, however, no automated translation is perfect nor is it intended to replace human translators. Translations are provided as a free service to users of the Platform, and are provided "as is." No warranty of any kind, either expressed or implied, is made as to the accuracy, reliability, or correctness of any translations made from English into any other language. Some content (such as images, videos, Flash, etc.) may not be accurately translated due to the limitations of the translation software.
The official text is the English version of the website. Any discrepancies or differences created in the translation are not binding and have no legal effect for compliance or enforcement purposes. If any questions arise related to the accuracy of the information contained in the translated website, refer to the English version of the website which is the official version.
3. Electronic communications
Each time an User interacts with the Platform or sends an email, text message (SMS), or other communication from the User computer or mobile device, the User is considered to be communicating with the Platform electronically. The Platform will contact the User electronically by various means, such as email, text messages (SMS), in-app notifications, or by posting messages or email communications on the website or through any licensed product of the Platform. For the purposes of this Agreement, Users agree that all contacts, notices and other notifications and communications that the Platform sends to Users by electronic means satisfy any requirement in writing, unless any mandatory applicable law requires a different form of communication.
4. Platform Activities - Breakdown of All Fields of Operation
Rental of Vehicles:
Indie Campers offers a wide range of vehicles for rent. This service is available directly through Indie Campers' own fleet, as well as through a peer-to-peer model where third-party vehicle owners (Hosts) can list their vehicles for rent on the Indie Campers platform. This dual approach allows for a diverse selection of vehicles to meet different customer needs and preferences.
Sale of Owned Vehicles:
In addition to renting vehicles, Indie Campers also engages in the sale of their owned vehicles. This typically involves selling vehicles from their rental fleet that are being retired or replaced, providing customers with the opportunity to purchase well-maintained and fully-equipped campervans at competitive prices.
5. Platform Users Registration
5.1 The Platform consists of a public area and a private area, which can be accessed in different ways and with different restrictions:
- 5.1.1 The public area allows access to the site, the use of the site as an unidentified User, benefiting from certain services and features provided by the Site.
- 5.1.2 The private area is accessible after identification and registration of the User. This identification requires the prior creation of a profile.
5.2 Upon successful registration on the private area of the Platform the User will be able to access various features, including, but not limited to:
- 5.2.1 Booking with Indie Campers Fleet (1P) or with a Third-Party Provider (“Host”), either private or professional, available on our Platform. In this case, the User will additionally acquire the status of “Traveller”
- 5.2.2 Register a Vehicle(s) at Indie Campers Platform and place listtings to Travellers, either as primary activity (Professional Host) or as a Secondary Activity (Private Host). The User that Lists his vehicle will additionally acquire the status of “Host”.
- 5.2.3 Sell a Vehicle(s) at Indie Campers Platform and advertise it to Potential Buyers. The User that advertises his vehicle will additionally acquire the status of “Seller”.
- 5.2.4 Buy a Vehicle(s) at Indie Campers Platform. The User that uses Indie Campers Platform to acquire a vehicle will additionally acquire the status of “Buyer”.
6. Scope of Application / Roadmap of Terms and Conditions
6.1 These Platform Terms and Conditions apply to all Users of the Platform, including but not limited to Travellers, Hosts, Buyers, and Sellers. They also apply to all transactions and interactions made through the Platform.
6.2 Indie Campers Terms and Conditions are divided as follows:
6.2.1 Platform Terms and Conditions
These terms are the starting point of the User journey with Indie Campers. These terms are a comprehensive set of rules, guidelines, and obligations that govern the use of the Platform. These terms define the relationship between the Platformand its Users, including but not limited to the use of services, user responsibilities, and the legal framework under which the Platform operates. The Platform Terms and Conditions cover all interactions, transactions, and engagements on the Platform, ensuring clear and consistent standards for all Users. These terms are always applicable to the User and are cumulative with the following terms and conditions.
6.2.2 Rental Agreement with Indie Campers Fleet (1P)
A specific contract between Indie Campers and a User (referred to as the Traveller) detailing the terms and conditions of renting a vehicle from the Indie Campers fleet. That agreement includes provisions on booking and payment, pick-up and drop-off procedures, use of the vehicle, responsibilities of authorized drivers, protection services, reimbursement of expenses, cancellation policies, liability, indemnification, dispute resolution, jurisdiction, and other miscellaneous terms. The Rental Agreement ensures both parties understand their rights and obligations during and after the rental period.These Terms and Conditions are cumulative with the Platform Terms and Conditions.
6.2.3 Peer to Peer Marketplace (3P)
A specific contract between the Platform and Travellers and Hosts detailing the terms and conditions of renting a vehicle from a Host and the interaction between the three parties. These Terms and Conditions cover all aspects of the rental process with a Third-Party, including booking and payment, vehicle listing and management, pick-up and drop-off procedures, vehicle use, responsibilities of authorized drivers, host and traveller duties, protection services, reimbursement of expenses, cancellation and refund policies, liability, indemnification, dispute resolution, jurisdiction, and complaint handling. They ensure clear understanding of rights and obligations among Indie Campers, Hosts, and Travellers, and are cumulative with the Platform Terms and Conditions.
6.2.4 Vehicle Sale (RV SALES)
These Terms & Conditions outline the entire agreement between Indie Campers (the Seller) and the person interested in buying (natural or legal)(the “Buyer”). They cover the scope of the agreement, the roles and responsibilities of both parties, notification procedures, and the reservation process, including the reservation fee, vehicle selection, and purchase. The terms detail the price, payment methods, and financing options available, as well as the procedures for vehicle collection, warranty, handling defects, and ownership transfer. These terms are cumulative with the Platform Terms and Conditions.
6.3 Users should ensure that they are familiar themselves with the structure of these Terms and Conditions to understand their rights and obligations clearly.
7. Business Locations
Indie Campers operates its rental, leasing, and sale activities in multiple countries. The some services are available in all countries while other are not.
8. Vehicle Selection
8.1 Vehicles for Renting
8.1.1 When searching and booking a vehicle at the Platform, Users can follow these steps:
- Access the Search Page: Visit the Platform search page.
- Enter Search Criteria: Input the desired pick-up and drop-off locations, along with the rental dates. For example, select "Marseille" as the pick-up and drop-off location, and choose the rental period from July 1, 2024, to July 31, 2024.
- Browse Available Vehicles: A list of available vehicles will be displayed based on the entered criteria.
8.1.2 Vehicle Options:
a) Indie Campers Fleet: Vehicles marked with the Indie Campers logo or label. These vehicles are owned and managed directly by Indie Campers.
b) Third-Party Provider: Vehicles not marked as being provided by Indie Campers. These vehicles will not have the Indie Campers logo and may be marked with the Host's details, Host Classification and other distinguishing elements.
c) Select a Vehicle: Click on a vehicle to view its details, including features, photos, pricing, and availability.
- Book the Vehicle: Follow the prompts to complete the booking process, including entering personal information, selecting additional services or protection plans, and making the payment.
8.2 RV Sales
8.2.1 When searching for RVs for sale on the Platform, Users can follow these steps:
- Access the "Buy a Campervan" Section:
- Visit the Platform and navigate to the "Buy a Campervan '' section.
- Choose the country where to purchase an RV.
- Browse Available RVs: A list of available models and model years will be displayed.
- Select the desired model and model year. If multiple mileage ranges are available, choose the one that fits your preference.
8.2.2 Reserve an RV:
a) Proceed to reserve an RV that matches the User selection criteria, including model, first registration year, mileage range, and price.
b) Payment of the reservation amount is done online and payment methods may vary depending on the selected country.
c)Arrange Viewing: Indie Campers will contact the User to arrange a viewing and inform of the sales process, including the anticipated delivery timing.
8.2.3 Complete the Purchase:
- Once the User decides to proceed with the purchase, it is finalized by completing the purchase contract and submission of full payment.
8.2.4 An Indie Campers agent will guide the User through the entire process.
9. Vehicle Availability
9.1 General Availability:
Vehicle availability is subject to change and is not guaranteed until the booking is confirmed. The Platform updates the vehicle listings regularly to reflect the current availability.
9.2 Indie Campers Fleet (1P):
Vehicles from the Indie Campers fleet are maintained and managed directly by Indie Campers. Availability is based on the fleet's current inventory and scheduled maintenance.
9.3 Third-Party Providers (3P):
Vehicles offered by third-party providers are listed on the Peer to Peer Platform based on information provided by the Hosts. Indie Campers does not guarantee the availability of third-party vehicles and advises Users to confirm details directly with the Host.
9.4 Indie Campers Fleet Vehicles for Sale (RV Sales)
At Indie Campers, we regularly expand and renew our fleet by adding new vehicles and updating a portion of our existing inventory. We offer these vehicles for sale to both individuals and corporate entities. Each vehicle undergoes a compliance process before it is listed for sale. 9.5 Booking Confirmation:
A booking is only confirmed once the User receives a confirmation email from the Platform. Until then, vehicle availability is tentative and may change.
9.6 Changes and Cancellations:
Indie Campers reserves the right to change or cancel the reservation or the sale of a vehicle , in extraordinary circumstances. In such cases, Indie Campers specific terms and conditions will apply.
10. Payments
10.1 Payment Providers
- Types of Payment Providers: Indie Campers partners with various payment providers to facilitate transactions on the Platform. Accepted payment methods include credit cards, debit cards, and other electronic payment systems as specified on the Platform.
- Buy Now Pay Later: The Platform offers a "Buy Now Pay Later" option, allowing Users to defer payment under certain conditions. Eligibility and terms will be provided during the booking process.
- Vouchers: Indie Campers may issue vouchers that can be used as payment for services on the Platform. Vouchers are subject to specific terms and conditions, which will be provided at the time of issuance.
- Promotional Codes/Promotions: Indie Campers may offer promotional codes or run promotions that provide discounts or benefits to Users. These are subject to specific terms and conditions, which will be provided at the time of the promotion.
10.2 Payment Processing: Transactions on the Platform are processed securely by Stripe. Stripe Technology Europe, Limited (STEL) is authorized by the Electronic Money Institution and regulated by the Bank of Ireland (reference number: C187865). Indie Campers cannot be held liable for payments made directly between Users. The Platform only guarantees the security of payments made through the Stripe partner.
11. Identity Verification
11.1 Minimum Eligibility Requirements: To book a vehicle from the Platform, the User must meet the following eligibility criteria:
- Hold a current, valid (non-temporary) driver's license.
- Successfully complete the identity verification and other background checks required by the Platform.
- Indie Campers reserves the right to cancel a booking if the User does not pass the identity verification process. In such cases, the applicable cancellation policy will apply .
- Indie Campers is not liable for penalties, fees, or any incurred costs in the case of reservations being made without a qualified driver. When planning to use our services, the customer is responsible for ensuring, in coordination with local traffic authorities or consulates, the validity of the driving license at the travel destination.
- Indie Campers does not assist in obtaining the International Driving Permit (IDP).
11.2 Application Process: The application process is designed to be quick and straightforward:
- Booking Confirmation: Once the booking is confirmed, the Platform will request the User's driver's license, passport, or government ID information.
- Verification: The driver eligibility check typically takes seconds, provided the Platform can verify all the User's information. Indie Campers may utilize third-party sources to complete this process. Indie Campers ensures that the User's information is not shared beyond this scope.
- Additional Information: In some instances, the Platform may require further information for verification purposes. If this is the case, Indie Campers will contact the User via email or phone to request the necessary details.
11.3 By meeting these requirements, the User ensures a smooth verification process and is prepared to start their trip without delays.
12. Guiding Principles
12.1 Compliance with Laws:
All Users, including Travellers, Hosts, and Indie Campers, must comply with applicable laws and regulations. This includes traffic laws, rental laws, and any other relevant legal requirements.
12.2 Respectful Behavior:
All interactions between Users must be conducted with respect and professionalism. Discriminatory, abusive, or offensive behavior will not be tolerated.
12.3 Accurate Information:
All Users must provide accurate and truthful information during the registration, booking, and transaction processes. This includes personal details, vehicle information, and payment details.
12.4 Timely Communication:
Effective and timely communication is essential. Users should respond promptly to inquiries, notifications, and any issues that arise during the rental or transaction period.
12.5 Payment of Fees:
All applicable fees, including rental fees, deposits, and any additional charges, must be paid on time. Users are responsible for ensuring they have sufficient funds or credit availability.
12.6 Use of Platform:
The Platform must be used in accordance with its intended purpose. Any misuse, fraudulent activity, or violation of these Terms and Conditions may result in termination of the User’s account and potential legal action.
13. Cancellation Policy
13.1 Indie Campers Fleet
13.1.1 Users have access to several cancelation policies when booking with Indie Campers Fleet. Such cancelations policies will be displayed at the booking process and in general will belong to one of the above categories:
- Flexible: Users can cancel bookings up to a specified time before the pick-up date without incurring fees.
- Partially Flexible: Partial refunds are available for cancellations made within a specified window
- Specific Location: Some bookings may have specific cancellation policies based on the pick-up location.
13.1.2 Indie Campers Fleet Extras: Users that have booked with Indie Campers Fleet will be will be able to acquire extras, those will have a dedicated cancellation policy.
13.2 For 3P Rentals: Cancellation policies vary by Host and will be provided during the booking process.
13.3 Indie Campers Fleet Vehicles for Sale: Indie Campers (“The Seller”) offers a 14-day money-back guarantee starting from the vehicle collection date. During this period, the Buyer can cancel the order and return the vehicle to the pickup location, provided the vehicle meets specific conditions outline on those terms and conditions.
14. Indie Campers Services and Extras
Users that book a rental with Indie Campers Fleet, being therefore, travellers, will be able to acquire extras and services.
14.1 Protection Services
- Indie Campers provides comprehensive protection services for its vehicles, ensuring coverage for a wide range of potential incidents, therefore, Travellers, are not obligated to contract their own insurance as Indie Campers provides sufficient coverage. However, they may choose to purchase additional coverage - Protection Service
- While the insurance provided by Indie Campers is included on the trip, Travellers have the option to add and purchase a Protection Service Indie Campers offers on top of the former, which are three predefined protection services, each designed to cater to the varying needs of our customers. These services include Basic, Standard, and Premium protection services, each providing different levels of coverage. Depending on the specifics of your booking, additional protection options may be available at the check-out page, allowing for further customization to ensure you have the optimal coverage for your needs.
- The three predefined protection services operate on the principle of Maximum Liability, which sets the highest amount a traveller may be held responsible for, excluding specified exclusions.
- A mandatory deposit is an integral part of these protection services. This deposit is an upfront payment held by Indie Campers to cover potential damages or extra charges that may arise during the rental period.
14.2 Accessory Services
In preparation for future travel needs, Indie Campers offers various accessory services, akin to those provided by a travel agency. These services include travel planning, campsite reservations, and activity bookings, ensuring a seamless and enjoyable travel experience for Travellers.
14.3 Extras
Additional extras are available for rental, such as camping gear, GPS devices, and child seats. Prices for these extras are displayed on the Platform.
15. Disputes
Users can always contact Platform through customer support or by email via the available contacts on the Platform
15. 1 Hosts and the Platform

15. 2 Host and Travellers Peer to Peer
In the occurrence of disputes between the Host and Travellers Peer to Peer they commit themselves to act according the Peer-to-Peer Terms and Conditions. Indie Campers provides a mediation service for complaints, aiming for fair and prompt resolution. Partiesare encouraged to resolve complaints through the platform before seeking external resolution.
15.3 Travellers and Indie Campers Fleet Rental

16. Encouragement of Resolution Through Consumer Agencies
16.1 Indie Campers encourages all users to seek resolution of disputes through the consumer protection agencies available in their respective countries before proceeding to binding arbitration. We believe that many issues can be resolved efficiently and amicably through these agencies, which offer resources and support for consumer rights and dispute resolution.

16.3 While we encourage this step, please note that if a resolution cannot be reached through these agencies, users still have the option to proceed with binding arbitration as outlined in our Binding Arbitration/ADR Clause and Class Lawsuit Waiver.
17. Binding Arbitration/ADR Clause and Class Lawsuit Waiver
17.1 Agreement to Arbitrate
By using the Indie Campers platform or any services provided by Indie Campers, all users, including travelers, hosts, and third parties, agree to resolve any and all disputes, claims, or controversies arising out of or relating to the use of the platform, services, or these terms and conditions exclusively through binding arbitration or alternative dispute resolution (ADR), rather than through the courts.
17.2. Scope of Arbitration Agreement
This agreement to arbitrate includes, but is not limited to:
Claims arising out of or relating to any aspect of the relationship between you and Indie Campers, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.
Claims that arose before this or any prior agreement (including, but not limited to, claims relating to advertising).
Claims that are currently the subject of purported class action litigation in which you are not a member of a certified class.
Claims that may arise after the termination of your use of the Indie Campers platform or services.
17.3. Arbitration Procedure
The arbitration will be conducted by a neutral arbitrator under the rules of a recognized arbitration organization mutually agreed upon by the parties. If the parties cannot agree on an arbitration organization, the arbitration will be conducted under the rules of the International Chamber of Commerce (ICC) or any other mutually agreed-upon body.
Initiation of Arbitration: To initiate arbitration, you must send a letter requesting arbitration and describing your claim to Indie Campers' registered address.
Arbitration Fees: Indie Campers will reimburse all filing, administration, and arbitrator fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. For claims exceeding $10,000, the payment of these fees will be governed by the arbitration organization's rules.
Arbitration Location: The arbitration will be conducted in a mutually agreed location. If the claim is for $10,000 or less, you may choose whether the arbitration will be conducted solely based on documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing.
17.4 Class Action Waiver
User and Indie Campers agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, unless both you and Indie Campers agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
17.5 Opt-Out Procedure
You can reject this arbitration agreement by mailing us a written opt-out notice within 30 days of first accepting these Terms of Service. The opt-out notice must include your name, address, and a clear statement that you do not wish to resolve disputes with Indie Campers through arbitration. This opt-out procedure is the only way you can opt-out of the arbitration agreement. If you opt out of the arbitration agreement, all other parts of these Terms and Conditions will continue to apply to you.
17.6 Governing Law
This Arbitration Agreement shall be governed by the applicable laws and regulations above:
Europe
Arbitration Procedure: The arbitration will be conducted under the rules of the International Chamber of Commerce (ICC) or any other European arbitration body mutually agreed upon by the parties.
Governing Law: This Arbitration Agreement shall be governed by the laws of the country where the user resides, in accordance with European Union regulations.
USA
Arbitration Procedure: The arbitration will be conducted under the rules of a recognized arbitration organization mutually agreed upon by the parties.
Governing Law: This Arbitration Agreement shall be governed by the Federal Arbitration Act and the laws of the state of your residence.
Canada
Arbitration Procedure: The arbitration will be conducted under the rules of the ADR Institute of Canada, Inc. (ADRIC) or any other Canadian arbitration body mutually agreed upon by the parties.
Governing Law: This Arbitration Agreement shall be governed by the laws of the province or territory of your residence.
Australia
Arbitration Procedure: The arbitration will be conducted under the rules of the Australian Centre for International Commercial Arbitration (ACICA) or any other Australian arbitration body mutually agreed upon by the parties.
Governing Law: This Arbitration Agreement shall be governed by the laws of Australia.
New Zealand
Arbitration Procedure: The arbitration will be conducted under the rules of the Arbitrators’ and Mediators’ Institute of New Zealand (AMINZ) or any other New Zealand arbitration body mutually agreed upon by the parties.
Governing Law: This Arbitration Agreement shall be governed by the laws of New Zealand.
18. Debt Collection
In the unfortunate situation where a user incurs a debt to Indie Campers or any other company within the Indie Campers group, the following procedures and actions may be taken to collect the outstanding amounts:
18.1 Use of External Debt Collection Agencies
Indie Campers reserves the right to use external debt collection agencies to pursue payment for outstanding debts. These agencies are authorized to take necessary actions to recover the debt on behalf of Indie Campers.
18.2 Legal Actions
Indie Campers may also proceed with legal actions against users who fail to meet their payment obligations. This includes filing lawsuits in appropriate courts to obtain judgments for the recovery of the outstanding amounts, including any associated legal fees and costs.
18.3 Additional Charges for Existing Debts
If a user with an existing debt to Indie Campers or any company within the Indie Campers group attempts to book or use any new service while still having an outstanding debt, Indie Campers reserves the right to:
- Add the amount of the existing debt to the charges for the new service.
- Require full payment of the outstanding debt before confirming the new booking or service.
- Refuse service until the outstanding debt is settled.
By using Indie Campers' services, users acknowledge and agree to these debt collection terms. Users are encouraged to promptly address any outstanding payments to avoid additional charges or legal actions.
19.Data Protection and Processing
19.1 Europe – GDPR
The collection, use, and storage of personal data in Europe are governed by the General Data Protection Regulation (GDPR) (Regulation (EU/EEA) 2016/679). Indie Campers processes your personal data lawfully, primarily for the performance of a contract or based on your consent where applicable. You have the right to access, rectify, delete, or restrict the processing of your data, among other rights. 19.2 North America
In North America, Indie Campers processes personal data in accordance with applicable U.S. federal and state privacy laws, including the California Consumer Privacy Act (CCPA), as well as Canadian privacy legislation. Where data is collected in the EEA, it is not transferred to the U.S. unless required by law. Indie Campers Canada, Inc. is located in a country deemed to have adequate protection under EU rules. Australia

New Zealand
In New Zealand, Indie Campers New Zealand Limited processes data under the Privacy Act 2020, ensuring lawful collection, use, and disclosure of personal information.
