1. Introduction
These Terms and Conditions govern the use of Indie Campers peer-to-peer Recreational Vehicle rental platform, setting out the rights and obligations of Hosts, Travellers, and Indie Campers Platform. By using the platform, all parties agree to adhere to these terms.
2. Scope of Application
2.1 These Terms and Conditions govern the interactions between the parties on 2.2, transactions, and activities conducted through the Indie Campers peer-to-peer rental platform. They outline the rights, responsibilities, and relationships between Indie Campers, Hosts, and Travellers, encompassing vehicle listings, bookings, payments, and dispute resolutions.
2.2 Application Coverage:
- Hosts: Both Private and Professional Hosts who list vehicles, manage bookings, and engage in rental transactions via the platform.
- Travellers: Individuals, legal entities and groups renting vehicles from a Host.
2.3 These Terms and Conditions are binding upon all users from the moment they engage with the platform, regardless of geographical location in order to list a vehicle type (being a Host), or rent from a Host Vehicle (being therefore a Traveller with a third-party).
2.4 Combination with Platform Terms and Conditions:
These Terms and Conditions are cumulative and must be read in conjunction with the Indie Campers Platform Terms and Conditions. This means that users are also subject to the broader platform rules and policies, which include guidelines on user conduct, data privacy, and the general use of the platform. In case of any conflict or discrepancy between these peer-to-peer rental terms and the general platform terms, the provisions in the Indie Campers Peer-to-Peer Terms and Conditions will prevail.
3. Roles and Interactions on the Platform.
3.1 Indie Campers and Hosts
Indie Campers provides the platform for Hosts to list and manage their vehicles, offering support and handling payments.
3.2 Indie Campers and Hosts
- All Hosts may receive additional services, such as extra paid marketing support
- Hosts manage their listings with Indie Campers' guidance, including insurance and assistance.
3.3 Indie Campers and Travellers
Indie Campers provides a platform through which Travellers can browse, request, and confirm bookings, and process payments. While the Platform may offer general support features, Indie Campers does not act as a party to the rental agreement between Hosts and Travellers and is not responsible for the condition, performance, or legal compliance of the Vehicle.
4. Payment
4.1 Its the Traveller responsibility to make the payment at the time of the booking reservation on the Peer-to-Peer Platform.
4.2 The payment made by the Traveller includes several components: the Platform Service Fee, the Insurance fee (if the Host has opted to use Indie Campers' insurance), a charge for the daily wear and tear of the vehicle, a preparation fee, and the Host’s commission.
4.3 Additionally, if the Host is a private individual (private host), the platform charges the deposit, which is governed by the rules outlined on this terms. In the event that the Host is a profissional, the deposit is managed by the host and the applicable rules are the ones outlined in the vehicle listing of such Host.
4.4 Payments are subject to the cancellation policies selected by the Host for their vehicles. Each host is responsible to choose of the following cancellations policies: https://help.indiecampers.com/hc/en-us/articles/32508347565329-What-is-the-Marketplace-cancellation-policy-How-does-it-work and clearly display them on the listing.
4.5 The funds paid by the Traveller are held in an escrow account by the platform and are only released to the Host (2) two to (5) five days after the Traveller picks up the vehicle at the designated location. The Host earns the full night rate and indie campers withhold a commission based on the full booking amount paid by the Traveller.
5. Host Terms and Conditions
5.1 Host and Vehicle Registration
5.1.1 All Hosts who wish to place their listings on the Peer-to-Peer Platform must create a Host profile and submit accurate details, documentation, and photographs during listing creation. Indie Campers encourages Hosts to ensure the quality and accuracy of these materials, which directly affect booking performance and visibility on the platform.
5.1.2 The Hosts of the Vehicles may be natural or legal persons and must ensure total ownerships or authorised management of the vehicle. Indie Campers will not be responsible or liable for verifying the above.
5.1.3 When opting into Indie Campers’ insurance solution, Hosts must provide accurate vehicle information (e.g., weight, registration year, value as new). Inaccurate information may affect insurance eligibility and should be corrected promptly to avoid coverage disruptions
5.1.4 Additionally, To be eligible to receive booking confirmations, Hosts must provide specific documents depending on their host type. This documentation supports platform security, payment processing, and regulatory compliance.
- For Private Hosts:
i. Completion of Stripe (payment provider) verification.
ii. Copy of the most recent vehicle inspection certificate, where applicable under local regulations.
iii. Copy of the vehicle registration certificate.
- For Professional Hosts:
i. Completion of Stripe (payment provider) verification.
ii.Copy of the most recent vehicle inspection certificate, where applicable, for at least one vehicle listed per model.
iii. Copy of the vehicle registration certificate for at least one vehicle listed per model.
iv. Copy of the business registration or equivalent legal documentation.
Indie Campers may request additional documents as needed, based on local regulatory requirements, insurance obligations, or payment provider conditions.
5.1.5 Hosts must ensure that all of the documents must be constantly updated. In the case of the Private hosts the vehicles listed will no longer be eligible for the insurance offered by the Platform and the announcement itself may be suspended until these are shared by the Platform.
For all Hosts, outdated or missing documents may lead to the temporary suspension of the affected listing. If, within five days prior to the start of a reservation, documents are found to be outdated, Indie Campers reserves the right to suspend the listing and cancel upcoming bookings until the documents are updated. Where possible, the platform will notify the Host in advance and provide an opportunity to correct the issue.
5.1.6 The Host consents to the right of the Platform to share these documents with the insurance partners as well as the payment partner. The Host also undertakes to share, with Indie Campers Platform the bank details for which the payments will be paid.
5.1.7 Indie Campers may conduct a summary check of the information and documents provided by the Host, focusing on the elements relating to the characteristics of the Vehicle and others. This check will be made at the time of registration of the Vehicle on the Platform andbut does not replace the Traveller’s own inspection at pickup. Indie Campers reserves the right to re-verify the documents at any time.
5.1.8 Indie Campers may, after verification, remove any vehicle Listing from the site or after news from one or more Travellers dissatisfied with the condition of the Vehicle and/or the Host's behaviour, as well as based on non-compliance with the current Terms and Conditions.
5.2 Indie Campers Liability for Vehicle Registration
5.1.7 Indie Campers can in no way be held responsible for errors, omissions or inaccuracies, whether voluntary or not, on the part of the Host with regard to the description and assessment of the Vehicle.
5.1.8 Indie Campers reserves the right to remove or suspend vehicle listings following, a verified breakdown, internal review, repeated traveller complaints, or evidence of non-compliance. Indie Campers will notify the Host and provide an opportunity to respond where possible. Indie Campers reserves the right to suspend any Vehicle offered for rental if it considers there is a risk that could affect the quality of the service. Suspension of the vehicle may result in cancellation of future reservations, and the Host of the vehicle will not be entitled to any compensation for any future reservations.
5.1.9 - Indie Campers shall not be held liable for the registration status, validity, or compliance of the Vehicle with applicable laws and regulations. Ensuring that the Vehicle is duly registered, roadworthy, and in full compliance with national and local requirements remains the sole responsibility of the Host.
5.2 Host’s Pricing
5.2.1 Host have Full autonomy to define price Hosts have full autonomy to set the rental price for their vehicles listed on the platform. While Indie Campers may provide non-binding suggestions or insights to help optimize pricing based on market trends and platform performance, the final decision rests solely with the Host. However, in order to align with platform standards and ensure a consistent customer experience, Hosts are encouraged to set pricing that reflects the true value of the vehicle—taking into consideration its equipment, condition, age, and mileage.and Indie Campers does not interfere. Platform Service may comment on and recommend but final word host
5.2.2 The Host is mandated to commit, under commitment of honour, to practise lower or equivalent final prices at Indie Campers Peer to Peer Platform compared to those offered in other platforms and on its own website, taking into account the different calculation systems of the respective platforms.
5.2.3 The Host undertakes to comply with the minimum availability requirements required by the Platform, which may be consulted on the website.
5.3 Host Requirements for Platform Engagement
5.3.1 By hosting on the Indie Campers platform the Host agrees to abide by our terms and conditions.
5.3.2 In case of repeated or serious violations, the Platform may suspend or permanently disable the host's account and unlist the vehicles.
5.3.3 To protect our community, the following behaviours are prohibited and may lead to the delisting of the Host:
- Retrieving Travellers from the Indie Campers platform for new, partial, or future bookings
- Deliberately providing false or misleading information about the vehicle's condition, features, or availability is prohibited. All listings must accurately reflect the vehicle offered.
- Contacting potential travellers before they make the reservation on the Indie Campers platform to change the reservation off Indie Campers Platform
- Host cannot ask travellers to fill out forms, or call, email, or contact them without the communications service of the Indie Campers platform before accepting booking requests
- Cancelling existing fully or partial bookings made by Traveller through the Platform and rebooking with such outside the Indie Campers platform.
- Asking or encouraging travellers to book outside the Indie Campers platform for repeat or future bookings
- Including links or embedding buttons (e.g. footers, headers) that take people off the Indie Campers platform to another website in any messages to travellers, including communications sent through the Platform
- Asking travellers for, or using contact or identity information in ways unrelated to their stay, or that compromise the quality of their stay
- Hosts may not charge additional fees outside of those explicitly stated in the listing, such as for extra mileage or cleaning, unless these are clearly outlined and agreed upon through the platform.
- Asking for or using the travellers contact information to settle additional payments outside of the Indie Campers platform all payments related to a travellers booking, including booking extensions and changes, must go through the Indie Campers platform.
- Asking travellers for contact information after a booking in order to conduct credit checks or background checks, unless for insurance purposes, in that case they must go through the Indie Campers platform.
- Asking travellers to submit photos of their government ID prior to arrival, except when required for legal or compliance reasons, in that case they must go through the Indie Campers platform.
- Asking for or using travellers contact information to settle additional payments outside of the Indie Campers platform all payments related to a travellers trip, including stay extensions (and other than the exceptions identified below), must go through the Indie Campers platform (e.g., using the Resolution Center)
- Sale, sharing, or use of travellers contact information for marketing communications or guest list sign-ups
- Feedback about a Travellers stay must not not be made outside of Indie Campers' Platform.
- Indie campers can still delist a host if their behaviour and actions are detrimental to the aims of the business, go against legal obligations, are discriminatory and damaging to travellers.
- Hosts must not discriminate against Travellers based on race, color, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
6. Travellers Responsibility
6.1 Travellers must comply with all rental terms, including the proper care and timely return of the vehicle. They are required to provide accurate and current identification and payment information at the time of booking, which includes a valid driver’s licence and credit card details.
6.2 Travellers are responsible for the cost of refuelling the vehicle throughout the rental period and must ensure the fuel level is the same as the level at pick-up. Additionally, travellers are responsible for all fines, tolls, or penalties incurred during the rental, including but not limited to parking tickets, traffic violations, and toll road fees. For bookings with a Private Host, these charges will be deducted from the Traveller's deposit or billed directly by the Indie Campers Platform. For bookings with a Professional Host, these charges will be billed directly to the Traveller by the host.
6.3 Travellers must use the vehicle responsibly, adhering to all applicable laws and regulations, and ensuring the vehicle is only used for its intended purpose and by authorised drivers. Upon return, the vehicle must be in the same condition as at the start of the rental, accounting for normal wear and tear. The Traveller may be charged for any damages, excessive dirtiness, or missing items.
6.4 Indie Campers acts solely as a booking facilitator and is not a party to the rental agreement between the Traveller and the Host. The platform does not assume liability for the conduct of either party or for the condition of the rented vehicle. Disputes relating to damage, payment, or rental conduct will be assessed and mediated where possible, in accordance with platform policies.
6.5 In the event of abnormal behavior of the vehicle—such as dashboard warnings, unusual noises, or mechanical faults—the Traveller must immediately inform the Host and, if instructed, stop using the vehicle until a professional inspection is carried out. Continued usage of a clearly faulty vehicle may lead to partial or full loss of deposit and further liability for repair costs.
6.6 If an incident or accident occurs during the rental period, the Traveller must report the incident to Indie Campers and the Host within 24 hours, using the designated claims reporting process. Failure to do so may result in denial of insurance coverage and the full cost of repairs or damages being assigned to the Traveller.
6.7 Travellers are required to complete the check-in and check-out process with the Host or Host’s delegate, which includes signing the rental agreement and vehicle condition form. Disputes regarding damage or cleanliness may not be considered if the check-in/out forms are missing or unsigned.
6.8 Travellers may not use contact details, personal information, or any platform-related communication to bypass the platform, misrepresent identity, or negotiate terms off-platform. Violations may lead to account suspension and removal from the platform.
7. Platform Responsibilities
7.1 Indie Campers is responsible for maintaining the functionality and accessibility of the platform, ensuring that the website and mobile applications operate correctly and securely. Where feasible, the platform may offer general assistance features intended to support Hosts and Travellers in navigating the booking and payment processes. Such assistance is provided without any guarantee of availability, accuracy, or resolution.
7.2 Indie Campers facilitates the processing of payments through third-party service providers, including the collection and transfer of rental fees, security deposits, and related charges. While reasonable efforts are made to ensure secure transactions and protect user information, Indie Campers does not guarantee uninterrupted or error-free payment processing and shall not be held liable for issues arising from third-party systems.
8. Security Deposits
8.1 Collection and Temporary Retention
- For bookings with Private Hosts, a security deposit is collected upon confirmation and held in a temporary escrow account managed by the Platform. This deposit is not transferred directly to the Host and serves as a safeguard against potential liabilities such as damage claims, excessive mileage, late returns, traffic violations, tolls, fines, penalties, unpaid expenses, or any other costs outlined in the rental agreement.
- For Professional Hosts, the handling of security deposits may follow a different process, including the possibility of direct management by the Host or use of alternative holding mechanisms, as communicated during the booking process
- The deposit serves as a safeguard against potential damages, excessive mileage, late returns, or other additional costs that may arise during the rental period such including, but not limited to, damage claims, traffic violations, tolls, fines, penalties, fees, unpaid expenses, and any other charges stipulated in the rental agreement with the Host.
8.2 Return of Deposit
At the conclusion of the rental period, if the vehicle is returned in the condition agreed upon in the rental agreement with the Private Host, the Platform will release the security deposit back to the Traveller. This process typically occurs within, 7-14 days after the rental ends.
8.3 Host Notification and Deposit Deduction Process
If the vehicle is not returned in the agreed-upon condition, the Host must notify Indie Campers, providing detailed information and evidence of any issues such as damages or extra charges.
If damage is noted during drop-off and recorded in a form signed by both Host and Traveller, Indie Campers may immediately deduct the corresponding amount from the Traveller’s security deposit, as this is considered mutual acknowledgment.
If damage or additional charges are identified after drop-off, the Host must notify Indie Campers within 7 calendar days of return, providing supporting evidence. In such cases, Indie Campers may temporarily capture the Traveller’s deposit and inform both parties that a claim has been raised. The Host then has 30 calendar days from the return date to submit a documented estimate or invoice for the damage or charges.
If no such documentation is submitted within this period, the security deposit may be automatically released to the Traveller.
8.4 Notification of Disputes and Deposit Handling
If the Traveller disputes a damage claim or related charges, Indie Campers will inform both parties that a dispute has been raised. Indie Campers does not intervene, assess, or resolve such disputes.
The release of the security deposit will occur based solely on the following criteria:
- If the Private Host notifies Indie Campers of the damage within 7 calendar days of vehicle return and submits documented repair costs within 30 calendar days, the corresponding amount of the deposit will be released to the Host.
- If the Private Host fails to meet either deadline, the entire deposit will be released to the Traveller.
- If both the Private Host and Traveller submit timely and valid documentation, but the matter remains factually disputed and unresolved, the security deposit will be automatically split 50/50 between the parties.This split does not reflect a decision on fault or liability and is made solely to close the matter procedurally.
9. Cancellation
9.1 Host
9.1.1 Hosts may choose from the cancellation policies made available by Indie Campers through the Platform. These predefined policies are set by Indie Campers and cannot be individually customized. Indie Campers may update or adjust the available policy options from time to time and will inform Hosts accordingly.
9.1.2 In case of cancellation of the reservation by the Host, Indie Campers will indicate other Vehicles under similar conditions to the one previously booked by the Traveller. In case the Traveller does not accept one of the Vehicles presented by Indie Campers, the amount paid by the Traveler will be refunded.
9.1.3 If the remuneration is already in the Host's possession, and although it is a cancellation on Host’s part, the Host is obliged to reimburse in full the amount received or Indie Campers may deduct this amount from future reservations.
9.1.4 If Indie Campers reasonably expects to provide a refund to a Traveller under one of the cancellation policies, Indie Campers may delay sending any payment to the Host for that booking until a refund decision is made.
9.1.5 In case the Host cancels a reservation, the Host will be charged a cancellation fee, to be charged directly or subtracted from the remuneration of subsequent reserves.
9.1.6 Hosts remain responsible to update their calendars to display accurate availability and avoid host cancellations due to non availability.
9.2 Traveller
9.2.1 Travellers must adhere to the cancellation policy associated with their booking. Refunds and fees depend on the timing and circumstances of the cancellation.
9.2.2 The cancellation policy will be applied according to the choice made by the Host before listing the vehicle. The Traveller can consult the Cancellation Policy that will be applicable to him by consulting the Host listing. Any amount returned, by way of a refund, will be deducted excluding Indie Campers Service fee, and a refund will be made within a maximum of 14 days from receipt of the cancellation request.
9.2.3 The occurrence of unforeseen or unavoidable events for which Indie Campers and Travellers have no responsibility (examples: force majeure, war, natural disasters, pandemics and strikes) does not invalidate the full application of the aforementioned provisions.
9.3 Indie Campers
9.3.1 Indie Campers reserves the right to cancel a reservation if the minimum requirements previously defined have not been respected by the Users.
9.3.2 The occurrence of unforeseen or unavoidable events for which Indie Campers and Users have no responsibility (examples: force majeure, war, natural disasters, pandemics and strikes) does not invalidate the full application of the aforementioned provisions.
10. Refund Processing
10.1 Refunds are issued in accordance with the cancellation policy agreed upon at the time of booking. Service fees are non-refundable. Indie Campers may adjust or withhold refunds in certain situations, in order to protect the integrity of the marketplace and its users.
10.2 Refunds may be adjusted or withheld under the following circumstances:
a) Cancellations or Shortened Bookings:
If a traveller or host cancels or shortens a booking, refunds are issued according to the applicable cancellation policy selected by the host at the time of listing.
b) Misuse of the Vehicle or Breach of Terms:
If the traveller violates the platform terms (e.g. unauthorized use, late return, insufficient cleanliness, or other contractual breaches), Indie Campers reserves the right to deduct corresponding penalties or costs from the refundable amount.
c) Disputes or Claims under Review:
If a refund request is subject to an open dispute, claim, or investigation (e.g. reported damage, missing items, or misuse), the refund may be delayed or partially withheld until the issue is resolved.
11. Booking Modifications
Bookings can be modified through the platform's and are subject to Host and Travellers agreement and approval. Potential additional charges may be applied by the platform for the change.
12. Host Vehicle Insurance
12.1 Hosts must ensure that the Vehicle is appropriately insured during the rental period.
12.2 Hosts may either provide their own insurance or select one of the insurance options made available through Indie Campers, where applicable. Regardless of the option chosen, the insurance must cover the full duration of the rental and meet the minimum legal and platform requirements.
12.2 Travellers are responsible for any damages not covered under the applicable insurance policy in force for the rental. Coverage terms, deductibles, and exclusions must be clearly disclosed in the booking process.
12.3 Professional Hosts are required to include the cost of basic rental insurance in their nightly rate. They may not request that Travellers arrange private third-party insurance or charge additional fees for insurance after booking confirmation.
13. Prohibited Activities
This section outlines specific behaviors and actions that are strictly prohibited for both Hosts and Travellers on the Indie Campers platform. These rules are in place to maintain a safe, fair, and respectful environment for all users. Violations may result in penalties, including suspension or permanent removal from the platform, and potential legal action.
13.1 Prohibited Activities for Travellers
Providing False Information:
Travellers must not provide false identification, payment information, or other misleading details when making a booking.
Unauthorised Use of the Vehicle:
Using the rented vehicle for illegal activities, transporting illegal goods, or allowing unauthorized drivers to operate the vehicle is strictly prohibited.
Damage and Misuse:
Travellers must not intentionally damage the vehicle or use it in a manner inconsistent with the rental agreement, such as participating in racing, off-roading, or other dangerous activities.
Failure to Return the Vehicle:
Not returning the vehicle at the agreed time and place, or without the agreed-upon level of fuel or condition, is prohibited. This includes retaining the vehicle beyond the rental period without proper authorization.
d) Off-Platform Communication:
Contacting Hosts outside the platform to negotiate bookings or any other arrangements is not allowed.
Harassment or Abuse:
Any form of harassment, abusive behaviour, or threatening actions towards Hosts or Indie Campers staff is strictly forbidden.
13.2 General Prohibitions
Data Security Violations:
Attempting to hack or otherwise interfere with the platform’s systems, or improperly accessing other users’ data, is prohibited.
Intellectual Property Infringement:
Users must not use Indie Campers' trademarks, branding, or other intellectual property without permission.
Circumvention of Platform Rules:
Any attempt to circumvent the platform’s rules, such as by creating multiple accounts to avoid penalties, is not allowed.
13.3 Consequences of Prohibited Activities
13.3.1 Violations of these prohibitions can lead to various consequences, including but not limited to:
- Immediate removal of listings
- Suspension or permanent banning of user accounts
- Forfeiture of payments or deposits
- Legal action for damages
14. Complaint Handling System
14.1 In the event of damage, breaches, or disagreements arising from a rental transaction, Indie Campers encourages Hosts and Travellers to make reasonable efforts to reach an amicable resolution. The security deposit mechanism and the procedures described in these Terms and Conditions are designed to support such outcomes.
14.2 Where the parties are unable to reach an agreement directly, Indie Campers may, upon request or at its discretion, offer a mediation service aimed at facilitating communication and resolution. This service is informal and non-binding, based on Indie Campers’ role as a neutral intermediary. Indie Campers does not act as a legal authority and does not provide legal advice.
14.3 Indie Campers will use its best efforts to manage the mediation process efficiently and fairly, and typically aims to complete mediation within 30 consecutive working days from the time the dispute is declared.
To initiate mediation, the dispute must be reported within 7 calendar days following the return of the vehicle.
Both parties are expected to participate in good faith and provide relevant documentation and responses in a timely manner.
14.4 While the mediation process does not impose legally binding decisions, Indie Campers expects users to respect the outcome proposed at the end of the mediation process and to follow through on agreed-upon next steps—such as refunding deposits, covering repair costs, or returning items—within reasonable timelines.
14.5 If the dispute remains unresolved following mediation, either party remains free to pursue legal remedies independently and at their own cost.
15. Limitation of Liability
15.1 Platform Disclaimer
Indie Campers provides a marketplace platform that facilitates peer-to-peer rentals of vehicles between Hosts and Travellers. Indie Campers Peer to Peer Platform itself does not own, create, sell, resell, provide, control, offer, or deliver any vehicle listed. The platform's role is solely to enable the communication and transactions between Hosts (vehicle owners) and Travellers (renters).
15.2 No Warranty for Vehicle Condition
Indie Campers does not guarantee the condition, safety, or suitability of any vehicle listed on the platform. All vehicle descriptions, conditions, and details are provided by the Hosts. Indie Campers does not inspect, verify, or endorse any vehicle, and thus, makes no warranties regarding the accuracy or completeness of the information provided by the Hosts. It is the responsibility of the Travellers to verify these details and assess the suitability of the vehicle before entering into a rental agreement.
15.3 Limitation of Liability
15.3.1 To the fullest extent permitted by law, Indie Campers, including its affiliates, officers, directors, employees, agents, and representatives, shall not be liable for any damages, including direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with:
- Errors or Omissions in Listings: Any inaccuracies or incomplete information provided by Hosts regarding the vehicles.
- Host or Traveller Conduct: Any actions or omissions by Hosts or Travellers, including issues related to the condition, use, operation, or rental of the vehicles.
- Third-Party Interactions: Any disputes, injuries, or damages arising from interactions between Hosts and Travellers, including but not limited to payment disputes, booking cancellations, and discrepancies between the vehicle description and the actual condition.
15.4 Host and Traveller Responsibilities
15.4.1 Hosts are responsible for ensuring that their vehicle listings are accurate and truthful, and for maintaining their vehicles in a safe and operable condition. They must also comply with all applicable laws and regulations.
15.4.2 Travellers are responsible for conducting their own due diligence before renting a vehicle, including verifying the condition and legality of the vehicle. They must adhere to all terms of the rental agreement, including proper use and timely return of the vehicle.
16. Modifications and Updates:
